GENERAL CONDITIONS OF SALE
Acceptance of the general conditions of sale and conclusion of the contract
The sales contract is considered concluded with the sending by Silence Shop to the Customer of an order confirmation email. The email contains the Customer's data, the order reference, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent and the link to print and archive a copy of these conditions. In the event of non-acceptance of the order, Silence Shop will in any case promptly notify the Customer.
By placing an order in the various ways provided, according to the order form on the Site (hereinafter the " Order "), the Customer declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these general conditions (hereinafter the " Conditions ").
These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
These Conditions may be subject to change and the date of publication of the same on the Site is equivalent to the date of entry into force.
How to purchase
The products offered for sale by Silence Shop are those present on the Silence Shop Website at the time the Order is placed, as described in the relevant information sheets.
To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products that he/she intends to purchase. The Customer must also request from Silence Shop , if desired, the issuance of a tax invoice relating to the purchase, pursuant to art. 22 DpR n. 633/1972.
The Customer undertakes to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to Silence Shop .
Silence Shop is committed to describing and presenting the items sold on the Site in the best possible way. However, some errors, inaccuracies or small differences between the Site and the actual product may arise. Furthermore, the photographs of the products presented on the Site do not constitute a contractual element, as they are only representative.
Prices and Payment Methods
To ensure maximum flexibility, we offer our Customers different payment solutions to complete their purchases. All prices on the Site are inclusive of VAT, net of shipping costs that will be indicated during the purchase process.
The following payment methods are available:
Paypal
When the Customer places a payment order with PayPal, he will be redirected to the latter's secure server.
If you have a Paypal account, simply enter your Paypal credentials (email and password) to complete the order. If you do not have a Paypal account, simply create a new account or click on "Pay with Debit / Credit Card": you will be redirected to a secure page where you can enter your credit or debit card details and complete the payment.
Before proceeding with the payment you will be asked to accept the PayPal "Terms and Conditions".
Payment will be registered within a few minutes and the order processed.
Credit card
Credit cards from the main international circuits Visa, Mastercard, Circuito Gest Pay, Maestro are accepted, with the additional guarantee of the Mastercard Securecode and Verified by VISA services.
In no case will Silence Shop be able to know and/or store the information relating to the Customer's credit card, transmitted via a protected connection directly to the Site of the banking institution that manages the transaction. Therefore, Silence Shop cannot be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.
Klarna (Payment by Installments)
With Klarna you can split your payment into 3 equal installments, interest-free. The first installment will be charged to your card at the time of purchase. The next 2 installments will be charged monthly.
If you buy with Klarna you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related entities and their assignees, and that you authorize such assignment.
Cash on delivery (cash on delivery)
Payment can be made in cash, up to a maximum amount of €200.00 directly to the courier upon delivery. This service has an additional cost of €3.00
Gift cards (GIFT CARD) are valid for 6 months from the date of purchase.
Shipping and Delivery Times
Shipments are managed by the express courier GLS
Shipping Cost
€5 for orders under €99
Shipments to the Islands cost €10.00.
However, during promotional or sales periods, they may be subject to change. During the purchase process, before sending the order, the current shipping costs and any other additional charges will be clearly indicated.
Delivery times
The delivery times indicated must be considered purely indicative and a delay with respect to the same does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.
The delivery of the goods will be carried out only from Monday to Friday, excluding public holidays.
ITALY: The purchased products will be delivered to the address indicated by the Customer during the purchase process, approximately within 3 (three) working days from acceptance of the order by Silence Shop
During sales or promotion periods or seasonal commercial events, shipments may require processing times exceeding 72 working hours.
Delivery conditions
Upon delivery of the products, the Customer is required to check, before signing the delivery document, that the packaging is intact, not damaged, not wet or in any way altered, including the sealing materials (adhesive tape or metal straps).
If the package appears to be tampered with or not intact, the Customer can sign the delivery document with reservation or refuse delivery.
In the event of a tampered package, if the Customer does not sign for receipt with reservations, the shipment is automatically considered accepted and no complaints will be accepted.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 (seven) days of delivery.
Right of withdrawal
Pursuant to art. 52 of the Consumer Code (Legislative Decree 206/2005), as amended by Legislative Decree 21/2014, the Customer may withdraw from the purchase contract within 14 (fourteen) working days from the date of receipt of the products, without having to provide any reason and without any penalty.
Exclusion of the right of withdrawal
Pursuant to art. 59 of the Consumer Code (Legislative Decree 209/2005) the right of withdrawal is expressly excluded:
a) for goods made to measure or clearly personalized
b) sealed goods which are not suitable for return for hygiene or health protection reasons and have been opened after delivery.
Furthermore, GIFT CARDS , any product without a label and items are excluded from the right of withdrawal. from the ACCESSORIES and BAGS collection.
Return conditions
In order for the Customer to exercise the right of withdrawal, the following conditions must be met:
a) The goods must be returned intact, complete with all their parts and accessories (including any documentation and accessory equipment: labels, tags, seals, warranty certificates) and in the original packaging (envelopes and boxes). The items to be returned must not have been worn, ironed, washed or treated in any way;
b) Any defects in the items must be reported promptly within 72 working hours of receiving the order;
c) The right of withdrawal may apply to the product purchased in its entirety and not exclusively to parts of it (e.g. accessories, complements, etc.);
d) The shipment for the return of the goods, until receipt at our headquarters, is under the complete responsibility of the Customer;
e) Shipping costs (and any customs charges) are the sole responsibility of the Customer;
f) Silence Shop is not responsible for any theft, loss, damage or delay in delivery of the goods, which may occur during or in any case in connection with the return shipment. The Customer may seek compensation from the courier and obtain the relevant reimbursement. The product will then be made available to the Customer and the request for withdrawal will be cancelled.
In the event of forfeiture of the right of withdrawal, Silence Shop will return the purchased product to the sender, charging the latter the shipping costs and, if already refunded, the price of the product.
Return instructions
The Customer can follow the guided procedure by accessing his personal account by clicking on the icon at the top right:
1. By accessing your reserved area you will find all the history of your orders;
2. Select the order you wish to return;
3. In the order details you will find a "Request Return" button;
4. Select the product to return and the reason for the return from the drop-down menu;
5. Click on the Request Return button.

Reimbursement
If the return procedure has been completed correctly, in compliance with all conditions, Silence Shop will refund the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14) within 14 (fourteen) days of withdrawal, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed.
Guarantees
All products sold by Silence Shop are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.
The guarantee for defects of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and with the provisions of the instructions for use and washing included in and/or with the product.
In the event that, for any reason, Silence Shop is unable to provide the Customer with a product under warranty (repaired or replaced), or if the repair or replacement were, also in light of the value of the product, excessively expensive, Silence Shop may proceed with an appropriate reduction in the price paid, or with the refund of the entire amount paid with termination of the contract.
In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

Privacy
The personal data collected by submitting the Order will be processed by Silence Shop for the sole purpose of satisfying the express requests of the Customer, in compliance with EU Regulation 2016/679 and the privacy policy on the Site. Any further processing will be carried out only with the express consent of the Customer.
Applicable law
The sales contract referred to in these Conditions and its execution are governed by Italian Law, with the non-application of the conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent for the resolution of the related disputes.
